These Terms of Service ("Terms") govern your use of the VYSN Performance app ("VYSN," "we," "us," "the App"), operated by VYSN Performance LLC, a Pennsylvania limited liability company. By creating an account or using VYSN, you agree to these Terms. If you don't agree, please don't use the App.
VYSN provides fitness, training, nutrition, and recovery information for general wellness purposes only. It is not medical advice, and it does not diagnose, treat, cure, or prevent any disease or medical condition. VYSN is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a physician before beginning any exercise, nutrition, or training program, especially if you have any pre-existing medical condition, injury, or concern. Stop immediately and seek appropriate medical attention if you experience pain, dizziness, chest discomfort, or any other concerning symptom during activity. You assume all risk associated with physical exercise undertaken using this App.
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to create a VYSN account or use the App. By using VYSN, you represent that you meet this requirement.
Physical exercise carries inherent risk of injury, including serious injury or death. By using VYSN's training, running, swimming, or any other activity-related features, you voluntarily assume all such risk. VYSN, its owners, and operators are not liable for any injury, loss, or damage arising from your use of the App or participation in any activity it suggests, tracks, or describes.

If VYSN offers merchandise or digital products for purchase, payment is processed by Stripe. All sales are final except as follows: unworn, unwashed items in their original condition may be returned within 30 days of delivery for a full refund. Return shipping is the customer's responsibility. Once we receive and inspect the returned item, your refund will be issued to your original payment method within 5–10 business days. Final sale/clearance items are not eligible for return. Prices are shown in USD and are subject to change. We reserve the right to cancel any order at our discretion, in which case you'll be refunded in full.
VYSN Membership (VYSN Pro) is an auto-renewing subscription purchased through your Apple ID, billed monthly. Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period; your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price. You can manage or cancel your subscription at any time in your Apple ID Account Settings — VYSN cannot process subscription cancellations or refunds directly, as all subscription billing is handled by Apple. Refund requests for subscription charges are subject to Apple's own refund policies. If a free trial is offered, any unused portion is forfeited once you purchase a subscription. Canceling your subscription takes effect at the end of the current billing period; you'll keep access you've already paid for until then.
Progress photos and personal notes you create in VYSN remain yours. Content you enter (journal entries, goals, notes) is stored for your own use within the App and is not published or shared publicly unless you explicitly choose to (for example, opting into a leaderboard or a circle's activity feed).
The VYSN name, logo, app design, and all associated branding are the property of VYSN Performance and may not be used without permission. The App itself, including its software and design, is protected by applicable intellectual property laws.
VYSN is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. We do not guarantee the App will be uninterrupted, error-free, or that any specific fitness or health outcome will result from using it.
To the fullest extent permitted by law, VYSN Performance and its owners are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App, even if advised of the possibility of such damages.
You may stop using VYSN and delete your account at any time. We may suspend or terminate access to the App for anyone who violates these Terms.
We may update these Terms from time to time. Material changes will be reflected by updating the date above, and where appropriate, we'll notify you in the App.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. VYSN Performance LLC is a limited liability company registered in Pennsylvania.
